Terms of Service
Rules for using the Ayniviva homestay marketplace.
Current version: 2026-10-03
Draft for Peruvian legal review. Before launch, Ayniviva must add its registered legal name, RUC, registered address, privacy contact, and complaints-book details.
1. Provider and scope
These Terms govern use of the Ayniviva marketplace by travelers and host families. The platform is provided by Ayniviva (“The Company”). Registered legal name, RUC and registered address: pending confirmation before launch.
You must be at least 18 and legally able to enter a contract. By creating an account or booking, you agree to these Terms and the documents incorporated into them.
2. Marketplace role
Ayniviva facilitates discovery, booking, payment holding, identity and field verification, education, messaging and support. The host family, not Ayniviva, provides the accommodation, meals and activities described in the listing.
Verification reduces risk but is not a guarantee that every stay will be free of incident. Hosts remain responsible for lawful, safe and accurate delivery of their services.
3. Accounts and acceptable use
Information supplied must be accurate and current. Users must protect their account, communicate respectfully, and must not circumvent the platform, misuse personal information, commit fraud, discriminate, or arrange off-platform payment for an Ayniviva booking.
4. Prices and payments
Prices are displayed in USD. Travelers see the host base price, the 10% guest service fee, discounts and total before confirming. Reference amounts in soles or euros are estimates only.
Ayniviva holds payment for the booking process. Host payouts are calculated under the Host Family Agreement and normally sent twice monthly after eligible completed stays.
5. Liability and support
Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer rights. To the extent permitted by law, each party is responsible for direct loss caused by its own breach, negligence or unlawful conduct.
Travelers should report safety issues promptly. Emergency services should be contacted first for urgent medical, fire or security incidents.
6. Law and disputes
These Terms are governed by the laws of Peru. The parties submit disputes to the competent authorities and courts of Lima, without limiting a consumer’s right to approach Indecopi or any mandatory consumer protections available in the consumer’s country of residence.
7. Changes and contact
The version accepted for a booking remains recorded with that booking. Material future changes will apply prospectively after notice. Legal contact details will be published here before launch.
